OMALAYA TRAVEL TERMS & CONDITIONS

In this agreement, ‘Omalaya Travel’, ‘we’ and ‘the agency’ refer to the tour organizers. ‘The participant’, ‘the client’, ‘the customer’ and ‘you’ refer to the purchaser of services offered by the tour organizers. ‘The tour leader’ refers to the partner teacher who represents the group participants.

 

 

1. Registration

 

 

Each tour participant must confirm that he/she is in good physical and mental health before participating in a Omalaya Travel tour. He/she agrees that it is his/her own responsibility to determine his/her ability to participate.

 

Registration deadline: --- November 2016 (120 USD late-booking fee thereafter).

To confirm your reservation, a non-refundable deposit of 500 USD must be deposited into our agency account by wire transfer. The remaining amount must be received on or before --- November 2016. A scan of the transaction details must be sent to info@omalayatravel.com.

Conditions of registration

 

Registration for the proposed journey requires the unconditional acceptance of the following conditions.

 

Registration is effective upon receipt of a 40% deposit and is subject to availability. If accepted, the balance of the fee must be received no later than 45 days before departure. For any registration made within 45 days of departure, the full fee must be paid.

 

1.2 Price Changes

 

Variations of more than 4% in exchange rates, together with significant changes in the cost of air travel (excluding airport taxes), train tickets and hotel accommodation may lead to a revision of the cost of the tour. In such an eventuality, we guarantee a price rise of no more than 10%, of which the customer will be notified at least 30 days before the departure date.

 

 

2. Security

 

 

Omalaya Travel advises you to check with your country’s foreign office website on security issues in the country you will be visiting, both before booking and departure.

 

 

3. Cancellation

 

3.1. Customer Cancellations

 

If you are obliged to cancel your trip, you must inform us directly by e-mailing info@omalayatravel.com. We will then send you an acknowledgment, upon which the cancellation will come into effect. Please note that our offices are open from Monday to Friday, 9am to 5:30pm (Indian Standard Time).

 

All cancellations made 45 days or more prior to departure qualify for a full refund, minus an administration fee of €250. For cancellations more than 45 days before departure, all payments above the deposit will be refunded. For cancellations less than 45 days and up to 30 days before departure, 60% of the paid amount will be refunded (excluding the deposit). For cancellations less than 30 days before departure, no refund will be made.

 

Please note that potential bank charges will be deducted from refund.

 

3.2. Omalaya Travel Cancellations

 

Omalaya Travel reserves the right to cancel the tour if fewer than the prescribed six group participants have registered two months prior to departure. In such an eventuality, Omalaya Travel will offer you either i) an alternative tour or ii) a full refund of your payment to us, excluding any bank charges incurred. Peripheral costs, such as travel visa, passport, vaccines, transfer to your domestic airport and international flights, are the responsibility of the participant and are not subject to refund.

 

N.B.

 

In addition to the specific cancellation policies above, Omalaya Travel reserves the right to cancel a tour in case of force majeure, including, but not limited to, natural disaster, political unrest and civil war. In such an event, wherever possible we will provide an alternative tour. Omalaya Travel will not be held responsible for peripheral expenses incurred by the client as part of their reservation, such as visa fees, vaccinations and non-refundable airline tickets.

 

 

4. Disruption of the tour

 

 

If the itinerary is delayed before or during the tour, due to natural disaster, road conditions, or other eventualities over which Omalaya Travel has no control, the agency will adjust the itinerary accordingly and will strive to act in the interests of the tour leader and the participants. However, no refund will be granted. Any additional costs that may arise (e.g. extension of the tour due to natural disaster) will be borne by the customer.

 

 

5. Refunds

 

 

Every begun tour is fully due. In case of illness or accident during the trek or tour, Omalaya Travel will implement measures appropriate to the situation. However, no refunds will be granted. Additional costs not covered by the tour participant’s payment for the tour will be borne by the tour participant.

 

 

Besides, please note that no refund would be granted in case the Kalachakra happened to be cancelled, whatever the reason is.

 

 

6. Risks

 

 

Each tour participant acknowledges and is fully aware that there are certain risks inherent in the practices of hiking and travelling over rough terrain. He/she agrees not to hold Omalaya Travel liable for any accidents that may occur.

 

Travelling in the Himalayas may include unforeseeable difficulties that cause delays, schedule changes or cancellations of visits. Despite the high quality of the accommodation provided during the tour, there might nevertheless be power outages and problems with hot water flow and pressure.

 

 

7. Insurance

 

 

Omalaya Travel is registered in India and subscribed a professional insurance. However each tour participant must obtain individual travel insurance (including repatriation insurance) and submit a copy of his/her insurance documents to Omalaya Travel upon arrival in India.

 

In case of illness or accident, it is the participant’s liability to support the related costs.

 

In addition, we recommend each participant to take out an insurance that covers the possible consequences of the cancellation or modification of his/her journey as well as the loss or the theft of his/her luggage.

 

 

8. Formalities

 

 

Each tour participant is required to comply with police and health formalities and regulations during the tour. In no event will Omalaya Travel take responsibility for the observation of formalities required of individual tour participants before or during the tour, including acquisition of passport and visa, and completion of customs formalities regulating the export of objects, such as carpets and antiques.

 

 

9. Liability

 

 

Pursuant to Article L.211-17 of C. Tourism, Omalaya Travel cannot be held responsible for the consequences of external events, including:

 

Loss or theft of your plane tickets. While booking transfer plane tickets, please wisely consider to have enough time for a flight change to your

final destination. Omalaya Travel cannot be held responsible in case of flight missing.

Failure to provide actual or valid proof of identity.

 

 

Unpredictable or insurmountable events such as war, political unrest or riots; administrative or technical problems external to Omalaya Travel; airspace congestion; failure of a service provider; weather; natural disasters; loss or theft of baggage or other personal effects. Delays incurred for any of the hereabove reasons, and also including route and itinerary changes will not result in any refund or compensation from Omalaya Travel.

 

Any additional costs related to disruption of the itinerary (e.g. taxis, hotel accommodation, parking, purchase of tickets) remain the sole responsibility of the tour participant.

 

Cancellation might be necessitated by force majeure and/or by maintaining the safety of passengers and/or as instructed

 

by an administrative authority and/or by any other eventualities over which Omalaya Travel has no control. In this case Omalaya Travel will seek to minimize the consequences of any unexpected events and help tour participants to adapt to new conditions.

 

No event or modification external to Omalaya Travel will result in any refund or monetary compensation.

 

No guidance is included, either to the airport of departing, or on flights.

 

Omalaya Travel offers the opportunity to meet healers (doctors, shamans) but under no circumstances can guarantee any recovery and be

held responsible for any trouble or complication during the tour or afterwards.

 

 

 

10. Tour quality safeguards

 

 

Omalaya Travel reserves the right to exclude any tour participant whose behavior is incompatible with the smooth

 

running of the tour or is detrimental to the welfare of others. In such an instance, the tour participant will not be entitled to any refund or reimbursement for expenses generated by his/her exclusion.

 

 

11. Legal Issues

 

 

Our conditions of sale are governed by Indian law. Any dispute arising between Omalaya Travel, the tour operator and the client will fall under the jurisdiction of the Indian legal system.

12. Encounters and guides

 

 

Because the exceptional people you will meet are also active community figures, there may be times when the itinerary will be altered to accommodate their community obligations
